Terms of sale
1. About these terms
These terms apply to purchases from melrosemachineworks.com (the "site"). Browsing the site and joining our list are covered by our Terms of Use. The store is operated by Melrose Companies LLC, doing business as Melrose Machine Works ("we", "us", "our"), 45 29th St., San Francisco, CA 94110. You agree to these terms when you check the box at checkout and place an order.
2. Who can order
You must be at least 18 years old and have a shipping address in a country we ship to. For now that is the United States.
3. Drops and purchase links
Pens are released in limited drops. We email individual purchase links to people on our list. Each link is for one person, may be used for one pen, and may expire. Links may not be sold or transferred. We may cancel and refund orders placed with a shared or transferred link, or multiple orders that appear intended for resale, and we will tell you why. This applies only to purchase links and orders. Once you own a pen, it is yours to keep, give, or sell, and the warranty goes with it.
4. Orders
Your card is charged at checkout. Your order is accepted when we send an order confirmation email. You may cancel for a full refund at any time before we ship. We may refuse or cancel an order before shipping for any lawful reason, including pricing errors, suspected fraud, or stock problems. If we cancel, we will tell you and you receive a full refund.
5. Prices and payment
Prices are in U.S. dollars and may change between drops. Shipping is calculated at checkout, and sales tax is added where required, based on your shipping address. Payment is processed by Stripe, which accepts major cards, Apple Pay, and other methods shown at checkout. We do not receive or store your full card number.
6. Shipping
We currently ship within the United States only. We plan to open shipping to Canada, the EU, and the UK once we have worked out duties, taxes, and carriers, and will announce it to our list. The estimated ship date is shown at checkout. If we cannot ship by that date, we will email you with a new date and the option to cancel for a full refund. If the new date is more than 30 days later, or we need to delay a second time, we will cancel and refund your order unless you tell us you want to wait. Refunds for cancelled orders are issued within 7 business days. We are not responsible for delays caused by events outside our reasonable control, such as carrier disruptions, supplier shortages, or natural disasters, though you can still cancel before we ship.
We are responsible for your order until the carrier records it as delivered. If the carrier shows your package as delivered but you do not have it, tell us within 7 days. We will open a carrier trace and claim, and if the carrier confirms the loss we will replace or refund your order.
If a package comes back to us because the address you entered was wrong, we will reship it once at your cost or refund the order less our shipping cost.
7. Returns and warranty
Returns are covered by our Returns & Refunds policy. Defects are covered by our Limited Lifetime Warranty.
8. Product details
Each pen is machined from bare C693 Eco Brass. It develops a natural patina from the first contact with skin, and this cannot be reversed. Small variations in surface finish, color, and tolerances are normal, and screens may not show the exact metal tone.
9. Intellectual property and site use
Use of the site, including our designs, photographs, logos, and text, is governed by our Terms of Use.
10. Limitation of liability
The Series I is sold as a writing instrument. We are not liable for injury or damage caused by using it as a tool, lever, or self-defense implement. To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim related to a purchase will not exceed the amount you paid for the item. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence.
11. Disputes
These terms are governed by the laws of the State of California. Please contact us first so we can try to resolve the problem. If we cannot, disputes will be heard in the state or federal courts in San Francisco County, California, except that either party may bring a claim in small claims court.
12. California residents
Under California Civil Code section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. Our contact information is in section 1.
13. Changes
We may update these terms and correct errors on the site at any time. The version posted when you place an order applies to that order.
14. Other
We communicate by email, and notices sent to the address on your order count as written notice. If any part of these terms is unenforceable, the rest remains in effect. If we do not enforce a term, we can still enforce it later. These terms, together with the policies they reference, are the full agreement between you and us for your purchase.
